These Terms of Service ("Terms") govern your access to and use of the website at alpenglowtreecare.com and the services provided by Alpenglow Tree Care LLC ("Alpenglow Tree Care," "we," "us," or "our"). By using our website or requesting our services, you agree to these Terms. If you do not agree, please do not use our website.
1. Services
Alpenglow Tree Care LLC provides tree care services including, but not limited to, tree removal, tree trimming, tree pruning, stump grinding, storm cleanup, lot clearing, fire mitigation, and chipping and mulching, throughout the Denver metro area, the Northern Metro, the Front Range Foothills, and Colorado's High Country. Descriptions of services on our website are general and do not constitute a binding quote.
2. Estimates & Pricing
Estimates are provided free of charge and are based on the information available at the time of assessment. Final pricing may change if site conditions, tree size, access, or the scope of work differ from what was initially observed. No work begins until pricing and scope are agreed upon. Written estimates are valid for the period stated on the estimate.
3. Scheduling & Weather
Tree work is weather-dependent and can be affected by wind, storms, snow, and ground conditions common across the Front Range. We reserve the right to reschedule work for safety reasons. We will make reasonable efforts to notify you of any changes to your scheduled appointment.
4. Property Access & Customer Responsibilities
You agree to provide safe and reasonable access to the work area and to identify, to the best of your knowledge, the location of underground utilities, irrigation lines, septic systems, pet fencing, and other hidden features. You are responsible for moving vehicles, furniture, and personal property away from the work zone unless otherwise arranged. We are not responsible for damage to undisclosed or unmarked private underground lines.
5. Permits, Easements & Property Lines
You represent that you own the property and the trees to be serviced, or that you are authorized to request the work. Some municipalities along the Front Range require permits for tree removal. You are responsible for confirming property lines and obtaining any required permissions; we can advise but cannot guarantee permit approval.
6. Payment
Payment is due upon completion of work unless other arrangements are made in writing. Late or unpaid balances may be subject to additional charges as permitted by Colorado law. Returned payments may incur a fee.
7. Licensing & Insurance
Alpenglow Tree Care LLC is a licensed and insured tree service company based in Broomfield, Colorado. Proof of insurance is available upon request.
8. Warranties & Disclaimers
We perform our work in a professional manner consistent with industry standards. Because trees are living organisms affected by disease, weather, pests, and soil conditions, we cannot guarantee the survival of any tree following pruning, trimming, or transplanting, nor can we guarantee that a tree will not fail in future storms. Except as expressly stated, our services are provided "as is" without warranties of any kind, express or implied.
9. Limitation of Liability
To the fullest extent permitted by law, Alpenglow Tree Care LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. Our total liability for any claim related to our services shall not exceed the amount you paid for the specific service giving rise to the claim.
10. Website Use
The content on this website, including text, images, and logos, is owned by or licensed to Alpenglow Tree Care LLC and is protected by applicable laws. You may not reproduce, distribute, or create derivative works without our written permission. You agree not to use the website for any unlawful purpose or in any way that could damage or impair it.
11. Indemnification
You agree to indemnify and hold harmless Alpenglow Tree Care LLC from any claims, damages, or expenses arising from your breach of these Terms or your misrepresentation regarding property ownership, access, or undisclosed hazards.
12. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Colorado.
